Drunk Frenchman pulls toy gun on Berlin police

BERLIN (AP) ? A Frenchman visiting Berlin probably couldn't have picked a more dangerous spot to pull a pretend pistol.

Police say the heavily drunk tourist kneeled down in front of Germany's biggest synagogue Thursday and pointed what appeared to be a gun at officers guarding the building.

Luckily for him, a quick-witted policewoman noticed that the weapon was a toy before her colleagues opened fire on the Frenchman.

Berlin police spokesman Dirk Stoewhase said the unnamed 25-year-old man could have ended the day in the morgue instead of a jail cell.

Stoewhase said the gun might easily have been mistaken for a real weapon because "it certainly didn't just look like a water pistol."

Jewish buildings in Germany are routinely guarded by armed police to prevent anti-Semitic attacks.

Little Piece of Rock Could Turn the Global EconomyIt is not usually a good idea to try and catch a falling piano.

So much change is in the air: the stock market breakout, declining commodity prices, and a world awash in cash.

Thinking about gold, it is just a piece of soft rock. But it?s a rock with a special connotation and with unique properties. It did a fantastic job helping the space shuttle, and a lot of people think it looks pretty good.

The first gold jewelry-makers must have been jumping for joy when they found a shiny rock they could shape without breaking. I read that approximately just 10% of gold production is used in industry; the rest is for jewelry and physical investment.

Because people throughout the centuries attributed value to gold, the soft rock has some worth.

Today, gold prices are determined by derivative traders, central banks, and what barterers believe it to be worth. This is not a group of market-makers that inspires confidence.

I certainly see a role for a little gold as part of an overall portfolio. It has always been a diversification, fear, and inflation-related hedging tool.

With lower gold prices, gold miners are struggling on the stock market. Even the best-quality, fastest-growing gold miners can?t get their stocks to move.

This is the inherent difficulty with resource stocks, and it will never change.

Predicting gold prices is a crapshoot. For the most part, it seems to me that gold prices just trade off their near-term directional momentum, save for a shock. Figures on the supply and demand of the commodity seem to play a lesser role in its price determination compared to other commodities, like oil, for example. The value attributed to gold by financial market participants offers little reliability. Making investments on an underlying commodity that is referred to as not only a store of value, but also a gauge of fear, is only about the current price momentum. That?s why the herd mentality in gold prices is so powerful.

I have no idea where gold prices are going. Last year, I thought that gold?s price momentum would resume, but clearly, this was not the case. Regardless of what happens to the value of this commodity, it really is just an asset for the sidelines of a portfolio.

The last time there was a spectacular bull market in U.S. dollar gold was in the late 1970s. After gold prices collapsed in the 1980s, another bull market ensued. That bull market was in the stock market.

MuleSoft Buys Programmable Web From Alcatel-Lucent, Marking The Telco's Departure From A Core API Community

pwebMuleSoft has acquired Programmable Web from Alcatel-Lucent effectively marking the telecommunication company’s exit from a core API community. For MuleSoft, a data integration company, the deal provides a vehicle for it to offer what it calls a GitHub for APIs that will integrate its APIhub with Programmable Web’s API database and rich editorial focus on the correlating market space. For Programmable Web, it provides a stable home, a place where it can extend its API database to a community that can build out apps using the MuleSoft APIhub platform. Programmable Web will continue to maintain its blog and API database. It will remain an independent entity and connect with the MuleSoft APIhub. The hub will serve as ?a place for getting the support developers often need when integrating APIs. Developers will collaborate on the APIs, similarly to the way a service like GitHub works. The larger goal is to help companies connect its legacy, on-premise systems to third-party services and platforms. Companies need to get their data out into the market. APIhub with Programmable Web will help accomplish that. MuleSoft essentially provides a message bus and a cloud platform for managing data integrations and connecting data points to services such as Workday or Salesforce. Alcatel-Lucent acquired Programmable Web in 2010. At the time, Alcatel-Lucent had hopes for fostering a developer ecosystem and build out its own API management strategy. But the effort never really seemed to take hold. Hopefully, it will be a different story with Programmable Web part of MuleSoft.

Durham High principal, athletic director resign following football coach's dismissal

DURHAM ? Durham High Principal Bill Frey and Athletic Director Jean Atkins have resigned from their positions, in relation to the Durham Unified School District superintendent's decision to not renew the contract of football coach Kevin York.

Frey said York, the coach of the Trojan football team the past two years, was notified April 5 that he would no longer have the position, despite recommendations from both Atkins and Frey, as per the school's athletic personnel re-hiring protocol.

District Superintendent Mary Sakuma could not be reached for comment on Thursday night. Board member Mark Kimmelshue said only, "I have no comment. I can't say a thing about it."

The resignations were first reported by KHSL-TV 12 Thursday afternoon.

"Kevin York's done so much for our district. I am just in shock. There's no valid reason," Atkins said. "Yes, they're totally legal in doing what they do and not saying a word, but there's something I feel is back-door going on, because there was no protocol followed. It's myself and Mr. Frey that deal with these things; we were not allowed in on it."

Atkins and York both said the former coach was given no reason for the decision after York met with Sakuma.

"I was called in, I was told that I would no longer be the football coach, and 'It's a district decision and I can't tell you why,'" York said. "I have not been given any reason. They've given us no reason why. I just have no idea."

Frey said that in February, when

the school submitted that York return as coach, the board expressed some concerns that were "not football-related," and that tied in to York's previous employment as a coordinator at Chico High.

"We called (Chico), verified his employment, and heard what we were looking to hear when we were looking for a football coach," Frey said. "They had questions, and all I can tell you is the questions they asked me about, Jean and I checked on those concerns and none of it came back. We didn't hear anything negative, and for me, that and the fact the board hired him two years ago was enough.

"Obviously, the answers (the board) got from us didn't please them," Frey said. He said he attempted to put up York and his entire staff for the position again, but was told he could not submit York as the program's coach while the board's concerns were still being reviewed. Frey said he still doesn't understand why.

"The board had some questions ? nothing to do with Durham High School ? and I answered them for them," he said, declining to say what those questions were.

York is not a teacher at Durham High, unaffiliated with any union, he said. None of his staff, including varsity assistants or any junior varsity coaches, will be brought back, either.

"At this very moment," York said Thursday night, "the entire program is without coaches. It's unfortunate for the kids. It affects a lot of them and it's going to be difficult to overcome this."

Typically, Atkins said, the school's rehiring process with coaches takes into account the candidate's body of work, an exit interview and parent and student feedback. Coaches are given a yearly contract, and the exit interview is mandatory before the coach is paid. Atkins said she was "really happy" with York's performance ? he has led one of the program's large fundraising projects while "singlehandedly" restoring the school's weight room, on top of his duties as coach.

"We were excited about it, about having him and all his coaches back," she said, "and the board just says, 'We have some problems,' and won't talk about them at all."

Atkins said she and Frey received just two phone calls over York's tenure ? one who felt York wasn't "motivating kids enough," and another who had a "personality issue with the coach." She said the latter complaint was quickly resolved with a discussion; the former was taken into consideration but not deemed as nearly negative enough to outweigh the good the school's supervisors felt York had done.

"As a parent, you have the right to feel anything you want to feel when it comes to your child, and it's a valid complaint. But is it something we'd get rid of a coach over? Absolutely not," Atkins said. "He has done so many positive things here for our student-athletes, it wasn't even a thought to get rid of Kevin for us."

Atkins, who also teaches at Durham and is the school's girls cross country and track coach, said she will step down from those roles, too, at the end of the year, unless the York decision is reversed.

"If this is how they choose to treat the coaches, with no protocol, I'm not going to be a part of it," she said. "It makes me sad, because I absolutely love what I do."

Frey's reasoning was similar.

"My concern is for the future. This could happen to any public staff or employee," he said, "and I didn't feel I could compromise my beliefs or principles. Not even allowing Kevin to hear why, or ask why, it's not how it should be done."

Cutting specific pollutants would slow sea level rise, research indicates

Apr. 14, 2013 ? With coastal areas bracing for rising sea levels, new research indicates that cutting emissions of certain pollutants can greatly slow down sea level rise this century.

The research team found that reductions in four pollutants that cycle comparatively quickly through the atmosphere could temporarily forestall the rate of sea level rise by roughly 25 to 50 percent.

"To avoid potentially dangerous sea level rise, we could cut emissions of short-lived pollutants even if we cannot immediately cut carbon dioxide emissions," says Aixue Hu of the National Center for Atmospheric Research (NCAR), the first author of the study. "This new research shows that society can significantly reduce the threat to coastal cities if it moves quickly on a handful of pollutants."

The study, a collaboration of the Scripps Institution for Oceanography, NCAR, and Climate Central, is being published this week in the journal Nature Climate Change.

"It is still not too late, by stabilizing carbon dioxide concentrations in the atmosphere and reducing emissions of shorter-lived pollutants, to lower the rate of warming and reduce sea level rise," says Veerabhadran Ramanathan of Scripps, who led the study. "The large role of the shorter-lived pollutants is encouraging since technologies are available to drastically cut their emissions."

Protecting the coasts

The potential impact of rising oceans on populated areas is one of the most concerning effects of climate change. Many of the world's major cities, such as New York, Miami, Amsterdam, Mumbai, and Tokyo, are located in low-lying areas by the water.

As glaciers and ice sheets melt and warming oceans expand, sea levels have been rising by an average of about 3 millimeters annually in recent years (just more than one-tenth of an inch). If temperatures continue to warm, sea levels are projected to rise between 18 and 59 centimeters (7 to 23 inches) this century, according to a 2007 assessment by the Intergovernmental Panel on Climate Change. Some scientists, however, feel those estimates are too conservative.

Such an increase could submerge densely populated coastal communities, especially when storm surges hit.

Despite the risks, policy makers have been unable to agree on procedures for reducing emissions of carbon dioxide. With this in mind, the research team focused on emissions of four other heat-trapping pollutants: methane, tropospheric ozone, hydrofluorocarbons, and black carbon. These gases and particles last anywhere from a week to a decade in the atmosphere, and they can influence climate more quickly than carbon dioxide, which persists in the atmosphere for centuries.

Previous research by Ramanathan and Yangyang Xu of Scripps, a co-author of the new paper, has shown that a sharp reduction in emissions of these shorter-lived pollutants beginning in 2015 could offset warming temperatures by up to 50 percent by 2050.

Applying those emission reductions to sea level rise, the new research found that the cuts could dramatically slow rising sea levels. Their results showed that total sea level rise would be reduced by an estimated 22 to 42 percent by 2100, depending on the extent to which emissions were reduced.

However, the new study also found that delaying emissions cuts until 2040 would reduce the beneficial impact on year-2100 sea level rise by about a third.

If society were able to substantially reduce both emissions of carbon dioxide as well as the four other pollutants, total sea level rise would be lessened by at least 30 percent by 2100, the researchers concluded.

The researchers used mostly percentage changes for sea level rise, rather than actual estimates in centimeters, because of uncertainties over future temperature increases and their impacts on rising sea levels.

"We still have some control over the amount of sea level rise that we are facing," Hu says.

Another co-author, Claudia Tebaldi of Climate Central, adds: "Without diminishing the importance of reducing carbon dioxide emissions in the long term, this study shows that more immediate gains from shorter-lived pollutants are substantial. Cutting emissions of those gases could give coastal communities more time to prepare for rising sea levels. As we have seen recently, storm surges in very highly populated regions of the East Coast show the importance of both making such preparations and cutting greenhouse gases."

To conduct the study, Hu and his colleagues turned to the NCAR-based Community Climate System Model, as well as a second computer model that simulates climate, carbon, and geochemistry. They also drew on estimates of future emissions of heat-trapping gases under various social and economic scenarios and on computer models of melting ice and sea level rise.

The study assumes that society could reduce emissions of the four gases and particles by 30 to 60 percent over the next several decades. That is the steepest reduction believed achievable by economists who have studied the issue at Austria's International Institute for Applied Systems Analysis, one of the world's leading research centers into the impact of economic activity on climate change.

"It must be remembered that carbon dioxide is still the most important factor in sea level rise over the long term," says NCAR scientist Warren Washington, a co-author. "But we can make a real difference in the next several decades by reducing other emissions."

The study was funded by the National Science Foundation and the Department of Energy.

Business and Legal Considerations in Choosing a Company Name

There are many considerations and problems to solve for anyone getting out in the market and starting their own business. One of the first considerations in starting your own company will be choosing a business name. Many people over look this task and simply jump right into a business name they believe sound good or somehow just works for what they are doing. Often, little consideration is given to the actual business and legal considerations involved in your company name. While we do not suggest you rack your brain for weeks trying to choose a name for your business, we do suggest a few really quick considerations. Provided here is a short checklist of issues we believe all entrepreneurs should consider in naming their company.

Business Considerations in Naming Your Company

  1. Name relates to product or service but does not unduly limit future expansion into new products or services. Keep the name specific to your industry but not so specific you paint yourself into a corner with name that wouldn?t make sense for any future expansion you could predict.
  2. Name relates to location of business but does not unduly limit future expansion of market area. For instance, when our firm started, if we would have named ourselves Utah Business Advisors LLC or something similar, that name would not work if our law firm expanded into other markets like Las Vegas or Los Angeles.
  3. Name will result in advantageous business directory placement. This is a big one for marketing purposes. A key word specific name can help with online marketing placement in directories.
  4. Name is easy to remember, spell, and pronounce.
  5. Name sounds or looks appealing and avoids negative connotations. Seems obvious but some companies don?t realize their name may have alternative meanings.
  6. Name captures attention and is unique in the business from its competitors.
  7. Name, or a derivative of the name, is available as a domain name for a Web site. In today?s online marketing world, this is huge. If you are a tech company, this is absolutely necessary.

Legal Considerations in Choosing a Business Name

  1. Name, or one that is confusingly similar, is not being used by other companies in your market area. In Utah, you can?t choose a name already chosen by another company. However, you may be able to choose one that is confusingly similar which could turn into a trademark or other legal battle with a competitor.
  2. Name is not registered or recorded as an assumed business name in the state or county.
  3. Nameis not being used by a corporation or limited partnership in the state.
  4. Name is not registered as a trademark or trade name in the state.
  5. Name is not registered as a federal trademark or service mark. Even if the name is not trademark in your state?s system, if it is trademarked federally you should absolutely avoid using that name.
  6. Name is subject to enforcement and registration as a trademark or service mark (for example, it is not merely descriptive of the goods or service of the business). This is important because if you are unable to trademark your name and your company is successfully, you can bet someone else will try to capitalize on your hard earned work into that name.
